Wendy has always been legal. Before the time skip, she was 12. However after being frozen for 7 years, shes actually 19 it's just her body hasn't fully developed due to being in stasis.

technically, even pre time skip she was legal. She and the other four 1st/3rd gen dragon slayers were from the distant past.

By applying real world's actual most usual laws, It would still not be a legal act what you think about. It would work as an argument to reduce the condemn.
