To be fair, we only know it's Jaune because Jaune is tagged on the source, so being out of character is really the least of our worries.

Seriously, even though Emerald is recognizable as herself, even her overall design is different enough that if it was tagged as Orignal, I'd be going "Yep, those sure are Original Character."

Bear with me here, but Jaune is not supposed to have any charactaristics of his own in these kinds of pics, which is why it's not Mercury. He's basically a blank piece of paper people use to draw 15+ pictures without having to resort to using tags like "OC" as that tag has quite a bad name.
