Newhalf does have it's own tag, so I guess that's good for this, but no, he's not being subjective. Newhalves are considered intersex, and in the world of hentai we aren't really restricted to saying they're sexually male or female with a defect, they can be their "own" thing. Did he originally make it 1boy or 1girl? I can't really tell because his comments don't indicate anything like that.

Futanari is also intersex, and requires both genitalia, shemale can be interchangeable with newhalf since they essentially have the same features.
