Ass kicked? By the end of the fight, Naruto had destroyed the six bodies he was using as puppets, but Pain still had access to all the powers of the rinnegan, and enough chakra left to revive all of konoha. Naruto won because he managed to convince Pain that the path he was on was not the right one.

Tobi, at least, doesn't have much plot hole, an incoherent story. Tobi literally participate at butchering the manga more and more, in term of plot and battle.
Pain was better, the only problem was the whole 'ressurect people' thing, It was here that thing will change in the manga.

as far as tragic villians go, Nagato is better than Tobito in that sense is that he lost everything from his home to his family and saw a lot of war crap than Tobito did. And his Village Hidden in the Rain was a main warzone for all the countries since it was right in the middle between all of them. Tobito is crying over the loss of one girl, and hasn't even cared about what's supposed to be the fate of the Uchiha clan unlike Sasuke.
