The requiments to be part of a sky battle are as follows
pokemon must be Flying type or have Levitate AND have a character model that is in flight. If the point is to have only airborne pokemon participate, they can't exactly let any pokemon that are clearly standing on the ground take part now, hmm? Its also why Gengar and first form birds can take part. It arbitrary, believe me I know, but that's an unavoidable consequence of have a thematic/gimmicked play style, and actually very well thought out. People were asking for this for years without considering the limitations of it, lets give Nintendo credit for doing their best to make it work and look right.

Scyther can't learn Fly but Pidgey can, it's all sort of out there.
Fortunately, they now have charts for Eligible Pokemon and Illegible Pokemon that fit the criteria. Check Sky Battle on Bulbapedia for it.
