The latter is debatable, though the former is a fair point; The cheating tag just plain has no place here. I'd argue that it's not NTR because we don't see Ichigo's reaction; half the point of NTR is the devastation faced by the cuckoldee, and this picture gives us no indication that Ichigo even minds.
