Okay, moving past all the nonsense in those previous 2 comments that makes my brain hurt...
1. Suguha and Kirito are biologically first cousins.
2. Kirito's parents died when he was too young to know what happened, and he was adopted by his aunt and uncle.
3. Kirito and Suguha were raised as brother and sister, neither even being aware they were actually only cousins by blood.
4. Kirito actually discovered he was adopted by his aunt and uncle first, and his almost instinctive feelings of betrayal at being lied to caused him to shut himself off from the rest of the family. This is when he turned to full-time gaming to avoid social relationships.
5. Suguha found out Kirito was adopted, and that he was actually her cousin and not her brother, after he had already been trapped in SAO. It was at this time that she [unrealistically] became romantically attracted to her now-not-blood-brother (evolutionary biology causes humans to be hard-wired to not be attracted to people who they were raised together with; typical cases of real-life adult incest happen between those who did not actually meet until adulthood).
6. Kirito woke up from his 2 years spent in SAO and, at least for a while in-story, was not aware that Suguha even knew they were actually adoptive siblings and blood cousins.
With all of that out of the way, Japan does not currently have any laws against incest between two consenting adults. Seriously.
It is, however, still a societal taboo, of course.

By the way, I literally never see anyone acknowledge the part where, in addition to being first cousins by blood, they are actually non-blood legal siblings at the same time. That's something people obsess over in literally every situation that does not also have some other familial relationship going on.
