technically it isn't incest as one, rukia and byakuya arn't blood related, so if they bang each other then it would be alright, as for their zanpaktos, they are just swords with souls, they don'treally have a body

Technically, kanda, they're a part of the shinigami's soul, given form as a weapon. Or, in the case of the filler, a body similar in composition to a shinigami's. So, they're really souls within souls.

Also, because of this, Sode no Shirayuki and Senbonzakura getting it on could be seen as pretty much the same as Rukia and Byakuya getting it on.

Plus, incest is a legal issue more than a biological issue. If two people are legally related in such a way that they could not legally be married to one another, it's incest. Of course, that's not necessarily the only definition of incest. Either way, most societies consider adopted siblings having sex to be incest.
